Strengthening Trust and Fairness in Employee Relations

In 2025, South African organisations continue to operate in an environment shaped by
increased employee awareness, higher CCMA activity, and stronger expectations around fair
treatment. Trust between employers and employees has become a critical HR priority,
underpinned by compliance with South Africa’s labour legislation.

The Labour Relations Act (LRA) places a clear obligation on employers to ensure both
substantive and procedural fairness in disciplinary and performance related matters. Employees
must be informed of allegations clearly, provided with sufficient information, and given a meaningful opportunity to respond. Vague communication or delayed feedback often
undermines otherwise valid processes and exposes organisations to unnecessary disputes.

Poor communication remains one of the leading causes of referrals to the CCMA. HR
professionals are responsible for ensuring that decisions, expectations, and outcomes are
communicated timeously and transparently, in line with the principles of fairness set out in the
LRA and supported by the Code of Good Practice on Dismissal.

The continued use of hybrid and digital workplace tools also requires careful consideration.

Online meetings, electronic records, and virtual processes must comply with the Protection of
Personal Information Act (POPIA). Employers must ensure that employee information is
processed lawfully, securely, and only for legitimate purposes.

In addition, HR teams should remain mindful of the Employment Equity Act (EEA), particularly
when managing performance, discipline, and promotions. Decisions must be consistent and free from unfair discrimination.

As organisations move through the second half of the year, HR teams are encouraged to focus
on proactive engagement, manager training, and regular policy reviews. Transparent and legally compliant employee relations practices remain essential to organisational stability and long term success.
